1. Acceptance of Terms

By accessing or using Sports1App ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms apply to all users, including candidates, employers, and businesses.

2. Description of Service

Sports1App provides an automated hiring and onboarding platform that enables:

  • Secure magic link authentication for candidates
  • Document upload and identity verification
  • Automated assessments and logic quizzes
  • Applicant tracking and management for employers
  • Customizable onboarding workflows

3. User Accounts and Registration

Account Creation

To use certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

Account Eligibility

You must be at least 16 years old to use the Platform. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

4. User Responsibilities

You agree to:

  • Use the Platform only for lawful purposes
  • Provide truthful and accurate information in applications and assessments
  • Not impersonate any person or entity
  • Not upload malicious code, viruses, or harmful content
  • Not attempt to gain unauthorized access to the Platform or other users' accounts
  • Not use automated systems (bots, scrapers) without our written permission
  • Comply with all applicable laws and regulations

5. Employer Responsibilities

If you are an employer using the Platform, you additionally agree to:

  • Comply with all employment laws and regulations
  • Use candidate information only for legitimate hiring purposes
  • Maintain confidentiality of candidate data
  • Not discriminate based on protected characteristics
  • Provide accurate job descriptions and requirements

6. Intellectual Property

Our Content

The Platform, including its design, features, text, graphics, logos, and software, is owned by Sports1App and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

User Content

You retain ownership of content you submit (resumes, documents, responses). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process it to provide and improve our services.

7. Payment and Subscriptions

Certain features require payment. By subscribing to a paid plan:

  • You authorize us to charge your payment method on a recurring basis
  • Fees are non-refundable except as required by law
  • We may change pricing with 30 days' notice
  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period

8. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy. We collect, use, and protect your information as described in that policy. By using the Platform, you consent to our data practices.

9. Disclaimers and Limitations of Liability

Service "As Is"

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPORTS1APP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Indemnification

You agree to indemnify and hold harmless Sports1App, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform or violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Any reason at our sole discretion

Upon termination, your right to use the Platform ceases immediately. We may delete your account and data, though some information may be retained as required by law.

12. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles.

Arbitration

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in Las Vegas, Nevada, except where prohibited by law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Platform. Your continued use after changes constitutes acceptance of the modified Terms.
